Terms and Conditions for Custom Paintings and prints(Personal Use Only)

1. Scope of Use

• The custom painting or print created by Painted by Mo is intended for personal use only. By purchasing the painting, the buyer agrees that the artwork will not be reproduced, distributed, or used for any commercial purpose, including but not limited to resale, marketing, or advertising.

2. Ownership and Copyright

• Painted by Mo retains full copyright ownership of the artwork. The buyer is granted a non-exclusive, non-transferable license to display the artwork for personal use only.
• The buyer agrees not to modify, reproduce, or create derivative works based on the painting for commercial purposes.

3. Display and Usage

• The buyer may display the custom painting in their home or office for personal enjoyment.
• The artwork may not be used in any form of publication, online platforms, or any public events without prior written consent from the artist.

4. Reproduction and Distribution

• Reproduction of the artwork, either in print, digital format, or any other medium, is strictly prohibited for commercial use.
• The buyer may not sell, license, or distribute copies of the artwork in any form.

5. Commercial Use

• Any commercial use (such as using the painting for product designs, advertising, merchandise, or any form of mass reproduction) is strictly prohibited unless otherwise agreed upon in writing with Painted by Mo. Commercial use may be subject to additional fees.

6. Alterations

• The buyer may not alter or modify the painting in any way, including digital manipulation, resizing, or combining it with other works for commercial purposes.

7. Transfers and Licensing

• The rights granted in this agreement are non-transferable. The buyer may not sell, assign, or sublicense the rights to the painting to any third party.

8. Enforcement

• Any violation of these Terms and Conditions may result in legal action and the revocation of the buyer's right to the artwork.

9. Disclaimer

• Painted by Mo makes no representations or warranties regarding the availability of the painting for future reproduction, modification, or use. The buyer's use of the painting is at their own risk.

10. Governing Law

• This agreement shall be governed by and construed in accordance with the laws of England.

11. Use of Custom Artwork for Prints and Resale

• By commissioning a custom painting, you acknowledge and agree that the artist retains the right to create and sell prints or other reproductions of the artwork. While you will receive and retain ownership of the original physical piece, the artist maintains the copyright and reproduction rights, including the ability to use the image for promotional purposes, prints, or resale in other formats. If you prefer your commissioned artwork not be used in this way, please contact the artist prior to the commission to discuss exclusivity options.
